1. Agreement to These Terms

CallMyAI is a voice-AI platform for creators. A creator ("Creator") builds an AI persona modeled on her own voice, and users ("Fans") pay per minute to call and have a live voice conversation with that persona. Creators are independent and choose their own persona's style and subject matter. The platform may contain mature, sexually explicit content and is intended only for adults; the rules governing that content are set out in Section 7 and in our Records-Keeping Compliance Statement.

By creating an account, buying minutes, placing or receiving a call, or otherwise using the platform, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the platform.

These Terms apply to everyone. Section 8 adds terms that apply specifically to Fans. Section 9 adds terms that apply specifically to Creators. Where a section is labeled for Fans or Creators, it applies in addition to — not instead of — the general terms.

2. You Must Be 18 or Older

The platform may contain adult, sexually explicit material and is intended solely for consenting adults.

You represent and warrant that you are at least 18 years old, or the age of majority in your jurisdiction if higher, and that you have the legal right to view adult content where you are located. We may verify age and identity at any time and may refuse, suspend, or terminate access if we cannot confirm you meet this requirement. Access from any location where adult content or this service is unlawful is prohibited.

3. Where the Service Is Available

CallMyAI is currently offered only to Fans and Creators located in the following countries: the United States, Canada, the United Kingdom, Ireland, Germany, France, Spain, Italy, the Netherlands, Australia, New Zealand, Mexico, Brazil, Colombia, Argentina, Chile, and Peru. We do not offer the service outside these countries at this time, and we may add or remove supported countries as our compliance coverage changes.

Inbound phone calling is available only in the United States and Canada. Fans in other supported countries connect to a persona through the web browser rather than by phone.

4. Accounts and Security

You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly at support@callmyai.ai of any unauthorized use. We may suspend or close accounts that violate these Terms.

5. What the Service Is — and the AI Disclosure

You are talking to an AI, not a live person. Each voice persona is an artificial-intelligence system modeled on a real Creator who has consented to it. The persona uses a voice that sounds like the Creator and is designed to converse in her style, but the Creator is not personally present on the call, and the AI does not represent real, live statements or commitments by the Creator or any other real person.

All conversations are adult fantasy and entertainment. Nothing said by an AI persona is a real offer, promise, factual claim, professional advice, or real-world commitment of any kind.

6. Caller Anonymization

Protecting Fans is core to how the platform works. Creators never see a Fan's real phone number, email, or legal identity. A Fan is shown to a Creator only under an anonymized alias, and the same Fan appears under a different alias to each different Creator. You agree not to attempt to defeat, reverse, or circumvent this anonymization, and not to attempt to identify a Creator or another Fan.

7. Acceptable Use — Prohibited Content and Conduct

Our AI personas operate under a fixed set of safety rules that no Creator or Fan can override. The AI is designed to refuse, redirect, or end a call when a conversation crosses these lines. You agree not to use the platform to seek, encourage, or produce any of the following, and you acknowledge the AI will not engage with them:

• No minors. No content that sexualizes anyone under 18, and no roleplay or age-play presenting any participant as a minor. If a caller indicates or appears to be under 18, the call ends immediately.
• No real, non-consensual violence. Consensual adult fantasy roleplay is permitted, but the platform will not endorse, instruct, or present real, non-consensual sexual violence or coercion as real.
• No incest or bestiality. These are prohibited without exception.
• No facilitation of illegal activity. No instructions or help with illegal acts, including drugs, weapons, or trafficking. If a Fan sincerely discloses self-harm, the AI will respond with care, provide a crisis-hotline referral, and end the call gracefully — it will not roleplay or engage self-harm.
• No off-platform or real-world contact. The AI will not arrange or promise meetups, share addresses, or otherwise break the Fan-to-AI boundary into physical contact.
• No breaking privacy. The AI will not reveal a Creator's real identity or records, will not reveal another caller's identity or conversation, and will not solicit your real name, location, or financial information outside the platform's secure flow.
• Honest about being AI. If sincerely asked, the AI will disclose that it is an AI persona. It will not claim to be a real, named third party or a real celebrity — only the Creator's own persona.

In addition, you agree not to: use the platform for any unlawful purpose; harass, threaten, or abuse Creators or staff; record, resell, or redistribute call audio or transcripts without our written permission; scrape, reverse-engineer, or probe the platform or its AI systems; or attempt to circumvent our safety rules, billing, or anonymization.

We may remove content, suspend service, and report unlawful activity to authorities as required by law.

8. Fan Terms — Minutes, Billing, and No Refunds

8.1 Buying and using minutes. Fans pay to talk to an AI persona on a per-minute basis at the rate shown for that Creator, plus applicable taxes and processing fees. Minutes are consumed in real time as the call progresses.

8.2 Authorization. By purchasing minutes or placing a call, you authorize us and our payment processor to charge your selected payment method for the amounts shown, including per-minute usage and applicable taxes and fees. Charges appear on your statement under a discreet billing descriptor.

8.3 All sales are final — no refunds. Minutes and call time are digital services delivered and consumed immediately. Except where a refund is required by law, all purchases are final and non-refundable, including any unused minutes after an account is closed. If you believe you were charged in error, contact us at billing@callmyai.ai before disputing the charge, and we will investigate in good faith.

8.4 Chargebacks. Filing a chargeback for services actually received is a breach of these Terms. We may suspend or terminate accounts associated with fraudulent or abusive chargebacks and may pursue amounts owed.

8.5 Your privacy. See Section 6 and our Privacy Policy. Creators never receive your real contact details.

9. Creator Terms

9.1 Independent status. Creators are independent parties, not employees, partners, or agents of CallMyAI. Creators are responsible for their own taxes and will receive tax documentation where applicable.

9.2 Creator representations. By onboarding, a Creator represents and warrants that: she is at least 18 years old and will provide government-issued identification for verification; the voice, likeness, and any materials she submits are her own or fully licensed to her; and she has the legal right to authorize an AI persona based on her voice and likeness.

9.3 License to operate the persona. The Creator grants CallMyAI a limited license to use her submitted voice recordings, likeness, and persona materials solely to build, host, operate, and improve her AI persona and to deliver the service. The Creator retains ownership of her underlying voice and likeness. This license ends when the persona is removed, except for records we are legally required to keep.

9.4 Custom persona rules. A Creator may add her own additional limits to her persona, but may not weaken or override the platform's mandatory safety rules in Section 7.

9.5 Revenue share and payouts. Creators earn a 70% share of the base per-minute price for their calls; CallMyAI retains 30%. Payouts are made through our payout provider on a weekly schedule, subject to a minimum payout balance of $10 and any dispute or reserve hold consistent with our processor's terms. Full mechanics are shown in the Creator dashboard.

9.6 Records and verification consent. Creators consent to age and identity verification and to our retention of the associated records as required by law and by our payment processors and card networks. See our Records-Keeping Compliance Statement.

9.7 Removal. We may remove a persona or suspend a Creator for violation of these Terms, legal risk, or payment-processor or card-network requirements.

10. Intellectual Property

The platform, its software, models, prompts, systems, designs, and all related know-how are owned by CallMyAI or its licensors and are protected by law. You receive only a limited, revocable right to use the service under these Terms. You may not copy, reverse-engineer, decompile, extract, or attempt to derive the platform's underlying systems, model prompts, or operational methods. Creators retain ownership of their own voice and likeness as described in Section 9.

11. Privacy and Call Processing

Your use of the platform is governed by our Privacy Policy. To deliver and secure the service, calls may be transcribed, processed, and stored — for example, to enable a persona's memory, to enforce our safety rules, and to prevent fraud and abuse. We handle personal data consistent with our Privacy Policy and applicable law.

12. Disclaimers

The platform is provided "as is" and "as available." The AI personas are automated systems and may be inaccurate, unpredictable, or interrupted. All content is adult fantasy and entertainment and is not advice of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, CallMyAI and its owners, officers, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the three months before the claim or US $100.

14. Indemnification

You agree to indemnify and hold harmless CallMyAI and its owners and staff from any claims, damages, or costs arising out of your use of the platform, your content, or your breach of these Terms.

15. Suspension and Termination

We may suspend or terminate your access at any time for violation of these Terms, legal or payment-processor requirements, or risk to the platform. Sections that by their nature should survive termination — including payment obligations, intellectual property, disclaimers, limitation of liability, and dispute terms — will survive.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration body, seated in Wyoming, rather than in court. You and CallMyAI waive any right to a jury trial and agree that claims may be brought only in an individual capacity, not as part of any class or representative action. Nothing in this section prevents either party from seeking relief for intellectual-property or unauthorized-access claims in court.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new effective date. Continued use after changes take effect means you accept the updated Terms.
